Terms of Use

1. Acceptance of Terms

By accessing or using My Best Day (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users, including free and paid subscribers. By creating an account, you represent that you are at least 13 years old and have the legal capacity to enter into this agreement.

2. Description of Service

My Best Day is a goal-setting and daily intention platform that helps users:

• Create and track personal goals
• Set daily intentions through AI-guided questions
• Receive personalized coaching through AI chat
• Track progress toward goals
• Receive reminders and notifications
• Integrate with Apple Health (iOS only) for health goal tracking

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, you must:

• Create an account using Google Sign-In
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Pricing

Available Plans

Billing and Payments

By subscribing to a paid plan:

• Payments are processed securely through Stripe or Apple In-App Purchase
• Subscriptions automatically renew unless canceled before the renewal date
• You authorize us to charge your payment method at the start of each billing period
• Prices are subject to change with 30 days notice to existing subscribers
• Launch special pricing is available to the first 500 users only

Free Trial

New users may be eligible for a free trial period. If you do not cancel before the trial ends, your payment method will be charged for the selected subscription plan. Trial eligibility and duration are determined by Apple or Stripe and may vary.

Cancellation and Refunds

You can cancel your subscription at any time:

• Web/Stripe subscriptions: Cancel in Settings. Access continues until the end of the current billing period.
• iOS subscriptions: Cancel through your Apple ID settings. See Apple's guide.
• Refunds: Generally, we do not provide refunds for partial months or unused time. However, we evaluate refund requests on a case-by-case basis.
• Annual Money-Back Guarantee: If you subscribe to the Plus Yearly plan and complete your daily intention for at least 170 out of 180 days within the first 6 months, you may be eligible for a full refund. Details provided upon enrollment.

5. User Content and Ownership

Your Content

You retain all ownership rights to the content you create on My Best Day, including:

• Goals, intentions, and progress notes
• Chat conversations with the AI coach
• Images and media you upload
• Any other content you submit

License to Us

By using the Service, you grant My Best Day a limited, non-exclusive, worldwide license to use, store, and process your content solely to provide and improve the Service. This includes:

• Storing your goals and intentions in our database
• Sending your content to OpenAI for AI-powered features
• Analyzing anonymized usage patterns to improve the Service

We will never sell your content or use it for purposes unrelated to providing the Service.

Data Export and Deletion

You can export all your data in JSON format from Settings at any time. If you delete your account, all your content will be permanently removed from our systems within 30 days, except where we're legally required to retain it.

6. Acceptable Use Policy

When using the Service, you agree NOT to:

• Violate any laws or regulations
• Infringe on the rights of others
• Submit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Scrape, copy, or automate access to the Service without permission
• Use the Service to harass, abuse, or harm others
• Share your account credentials with others
• Reverse engineer or decompile any part of the Service

Violations may result in immediate suspension or termination of your account.

7. AI-Generated Content

My Best Day uses AI (powered by OpenAI) to generate personalized questions, coaching responses, and suggestions. While we strive for accuracy and helpfulness, AI-generated content may occasionally be incomplete, inaccurate, or not suitable for your specific situation.

Important: My Best Day is not a substitute for professional medical, mental health, legal, or financial advice. If you need professional help, please consult a qualified professional.

8. Third-Party Services

My Best Day integrates with third-party services:

• Google OAuth: For authentication (Google Privacy Policy)
• OpenAI: For AI features (OpenAI Privacy Policy)
• Stripe: For payment processing (Stripe Privacy Policy)
• Apple Health: For iOS health data integration (optional)

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of these third parties.

9. Intellectual Property

All aspects of the Service, including design, text, graphics, logos, icons, images, audio clips, code, and software, are the property of My Best Day or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• AI-generated content will be accurate, complete, or suitable for your needs
• Any bugs or defects will be corrected
• The Service will meet your expectations or achieve specific outcomes

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY BEST DAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of your data
• Any interruption or cessation of the Service
• Any bugs, viruses, or malicious code transmitted through the Service
• Any errors or omissions in content, or any loss or damage incurred as a result of using AI-generated content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless My Best Day, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or conduct on the Service

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and My Best Day individually. You waive your right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or other factors. If we make material changes, we will notify you via email or through a prominent notice in the app at least 30 days before the changes take effect.

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may cancel your subscription.

15. Termination

You may terminate your account at any time by contacting support or deleting your account in Settings. We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or for any other reason at our sole discretion.

Upon termination:

• Your right to access the Service immediately ceases
• Your data will be retained for 30 days, then permanently deleted
• You remain responsible for any outstanding charges
• Sections of these Terms that by their nature should survive termination will continue to apply

16. Miscellaneous

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and My Best Day regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.
